
Is there anything I can do before my DUI conviction?
There will be a multitude of penalties raining down on me when I am convicted of my second DUI in Colorado. My question is is there anything I can do such as AA and other programs that will not only get them out of the way, but could possibly alleviate some of my sentencing?
Before you get mad and start ranting about how I should be locked up forever, please give your fingers and your keyboard a break. You are perfect, I know. I know DD is f-ing stupid and I am remorseful for committing this crime, so refrain. I am looking for serious advice.
What you are asking about is ‘mitigation’. You want to show the court all the good you do for your family, the community, your church, etc. So make a list and talk it over with your lawyer.
As for AA, etc., if you are in a program and can show the court that you are remorseful, are sincere about learning and changing your relationship with alcohol, that may help.
But none of that actually counts in the sentence, except maybe for “days served” in jail already if you receive a jail sentence.
If the court orders a year of AA, you generally can’t use last year’s attendance as a credit.
