
In California, what are the chances of someone being found not guilty, for 3rd offense driving w/o a license?
Know someone going to jury trial, pled not guilty and has an Attorney for 3rd offense driving while license is suspended. She hid from police and bench warrant was issued. She finally turned herself in. 2 prior DUI’s, that’s why license had been revoked. Was on probation, had no license, registration etc. Was not charged with DUI the 3rd time. What can she expect? Does it matter that she’s female? Is jail time ever involved or can she skate around it. (Orange County, California)
No, it doesn’t matter that she’s female. There would be jail time involved on a second or more conviction. No, she can’t just skate around it. The presumption is she knew her license was suspended.
People think that driving on a suspended license (a violation of 14601.1 of the Vehicle Code) is not that big of a deal. And probably in the big scheme of things, it’s not. But the penalties can be harsh.
